The 5th Circuit Court of Appeals’ decision to vacate the SEC’s proposed Private Fund Advisors Rule.  The Court agreed with the position of the LSTA and five financial services trade associations that the SEC lacked the authority to implement this rule. This decision ensures that the private fund managers responsible for hundreds of billions of dollars in loans will not be negatively impacted by this rule.
